5. User Content and Licenses

You retain ownership of all content you submit to the Service, including writing samples, generated content, and other materials ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store such content solely for the purpose of providing and improving the Service.

5.2 Generated Content

Content generated by your AI agent using the Service ("Generated Content") is owned by you. You are solely responsible for reviewing, approving, and publishing Generated Content. We do not guarantee the accuracy, appropriateness, or legal compliance of Generated Content.

5.3 Content Restrictions

You agree not to submit or generate content that:

Infringes any intellectual property rights
Is defamatory, obscene, or offensive
Contains malware or harmful code
Violates any applicable laws or regulations
Constitutes spam or unauthorized advertising
Impersonates any person or entity

6. Third-Party Integrations

The Service integrates with third-party platforms (e.g., Typefully, X/Twitter, LinkedIn). Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, functionality, or policies of third-party services.

You are responsible for ensuring your use of the Service complies with the terms of service of any connected third-party platforms.

7. Payment Terms

Certain features of the Service require payment of fees. By subscribing to a paid plan, you agree to:

Pay all fees associated with your selected plan
Provide accurate billing information
Authorize recurring charges for subscription plans

Fees are non-refundable except as required by law or as expressly stated in our refund policy. We reserve the right to modify pricing with 30 days' notice.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE GENERATED CONTENT WILL BE ACCURATE, APPROPRIATE, OR SUITABLE FOR YOUR PURPOSES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VIRALGHOST, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless ViralGhost and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, your Generated Content, or your violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will cease immediately.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Cayman Islands, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of the Cayman Islands arbitration authority, unless otherwise required by applicable law.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the modified Terms.
